Climate Change - No appeal in Rocky Hill Mine
In Gloucester Resources Ltd (GRL) v Minister for Planning [2019] NSWLEC 7 (see 10 March 2019 post) the NSW Land and Environment Court confirmed an earlier refusal to grant approval to the Rocky Hill Mine Project. Approval for the Project was refused by the Court on planning, visual and social grounds but also due to its climate change impacts.
A notice of intention to appeal had been lodged by GRL on 5 March 2019. However, on 8 May 2019 GRL advised that it will not pursue its appeal in the NSW Court of Appeal and that the Rocky Hill Mine “will not proceed”.
